By accessing this webpage, you are agreeing to be bound by these Terms and Conditions (“Terms”) in a legally binding agreement between us (“Merchant” or “us” or “we” or “our”) and the User (“you” or “your”). We reserve the right to update and change the Terms and Conditions by posting updates and changes to the Platform. You are advised to check the Terms and Conditions from time to time for any updates or changes that may impact you. If at any point such amendments are not acceptable to you, we advise you to cease using the Platform at such time.

1. Eligibility

• You hereby represent and warrant that you have the right, power, and authority to agree to the Terms, to become a party to a legally binding agreement, and to perform your obligations hereunder.

2. Definitions

• “Payment Instrument” includes credit card, debit card, bank account, prepaid payment instrument, Unified Payment Interface (UPI), Immediate Payment Service (IMPS) or any other methods of payments which shall be developed or added or deployed by banks and financial institutions from time to time.
• “Platform” refers to the website or platform where the Merchant offers its products or services and where the Transaction may be initiated.
• “Transaction” shall refer to the order or request placed by the User with the Merchant to purchase the products and/or services listed on the Platform by paying the Transaction Amount to the Merchant.
• “Transaction Amount” shall mean the amount paid by the User in connection with a Transaction.
• “User/Users” means any person availing the products and/or services offered on the Platform.
• “Website” shall mean www.instamojo.com or the mobile application.

3. Merchant’s Rights

• You agree that we may collect, store, and share the information provided by you in order to deliver the products and/or services availed by you on our Platform and/or contact you in relation to the same.

Your Responsibilities

• You agree to provide us with true, complete, and up-to-date information about yourself as may be required for the purpose of completing the Transactions. This information includes but is not limited to personal details (name, email address, phone number, delivery address, age, gender) and accurate payment information.

4. Prohibited Actions

You may not access or use the Platform for any purpose other than that for which we make the Platform available. The Platform may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a User of the Platform, you agree not to:

1. Systematically retrieve data or other content to compile a database or directory without our written permission.
2. Make any unauthorized use of the Platform, including collecting usernames and/or email addresses for unsolicited emails or creating accounts by automated means.
3. Circumvent or interfere with security features of the Platform.
4. Trick, defraud, or mislead us or other users, especially to obtain sensitive account information.
5. Misuse support services or submit false reports.
6. Engage in automated system use like scripts, bots, or data extraction tools.
7. Interfere with or disrupt the Platform or its services.
8. Impersonate another user or use another user’s credentials.
9. Harass or harm another person using information from the Platform.
10. Use the Platform to compete with us or for unauthorized commercial purposes.
11. Decipher, decompile, disassemble, or reverse-engineer any software on the Platform.
12. Bypass any access restrictions or security measures.
13. Harass or threaten any employees or agents.
14. Copy or adapt Platform software/code (Flash, PHP, HTML, JavaScript).
15. Upload or transmit malware or spam that disrupts Platform use.
16. Disparage, tarnish, or harm us or the Platform in any way.
17. Use the Platform in violation of applicable laws or regulations.

5. Limitation of Liability

1. Your only recourse for defective products or deficient services is to initiate the refund process per the applicable terms. We expressly disclaim any liability for losses.
2. You shall indemnify and hold harmless the Merchant, its affiliates, agents, and representatives from all claims or liabilities arising from your breach of these Terms.

6. Guidelines for Reviews

We may allow you to leave reviews or ratings on the Platform. You must comply with the following criteria:

1. Only leave reviews based on firsthand experience.
2. Do not use offensive, abusive, racist, or hate speech.
3. Do not include discriminatory references or illegal activity.
4. Do not post false/misleading statements or negative reviews if affiliated with a competitor.
5. Do not organize campaigns for review manipulation.

We may remove reviews at our discretion and are not liable for any claims arising from reviews. By posting a review, you grant us a perpetual, royalty-free license to use and distribute it as needed.

7. Governing Laws & Dispute Resolution

1. These Terms are governed by the laws of India. Courts of India have exclusive jurisdiction.
2. Any disputes shall be resolved through arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996.
3. Parties shall mutually appoint a sole arbitrator within 30 days of the dispute notice. Failing that, an arbitrator will be appointed as per law.
4. Arbitration will be conducted in English, and kept confidential.
5. Parties may seek injunctive relief from Bengaluru courts when necessary.
6. Costs of arbitration shall be shared as determined by the arbitrator. Each party initially bears its own costs.

8. Grievance Redressal

If you have any complaint related to a product, service, or transaction (e.g., double debit, unauthorized or fraudulent transaction), you may reach out here.

9. Disclaimer

1. Upon initiating a Transaction, you agree to pay the listed price using valid and legal Payment Instruments.
2. We may share your information for fraud verification or as required by law.
3. We disclaim liability for unauthorized use of Payment Instruments and for payment declines, errors, or system issues.
4. You must treat any access credentials as confidential and not share them.
5. Information on our Platform is for general use and not professional advice.
6. Links to third-party websites are not endorsements; we are not responsible for their content.
7. User-generated content is not verified by us and does not reflect our views.
8. We do not guarantee the Platform is free from bugs or viruses. You must use your own virus protection.
